General sales conditions
ARTICLE 1 - OBJECT
These general sales conditions (“GSC”) aim to define the conditions under which an individual (the “Customer”) can book the karaoke room service (the “Rooms”) online on the website www.playbackmadrid.com, provided by the company PLAYBACK MADRID, S.L., with Tax ID Number B67662676 and registered address at Calle Piamonte, 12 – 28004 Madrid.
ARTICLE 2 - SCOPE OF APPLICATION OF THE GSC AND DATA PROTECTION POLICY
ARTICLE 3 - MODIFICATION OF THE GSC
3.1. PLAYBACK reserves the right to modify these GSC at any time and at its sole discretion.
3.2. Therefore, the Customer must review the GSC and any changes made before each order confirmation (implying acceptance of the GSC).
ARTICLE 4 - CLAUSES OF THE GSC
4.1. The invalidity of a contractual clause shall not invalidate these GSC.
4.2. The temporary or permanent non-application of one or more clauses of the GSC by PLAYBACK shall not constitute a waiver by PLAYBACK of the other clauses of the GSC that remain in effect.
ARTICLE 5 - DESCRIPTION OF THE ROOMS
The Customer will have the possibility to book the following 8 rooms:
Two 4-person rooms
One 6-person room
Two 8-person rooms
One 10-person room
One 12-person room
One 16-person room
ARTICLE 6 - PRICE OF BOOKING SESSIONS
6.1. The prices of the booking sessions indicated are in euros, including VAT and per room. Prices can be consulted on the Playback website at the time of booking.
In general, prices vary according to the day of the week and the chosen schedule. Prices may differ depending on the chosen establishment.
Karaoke sessions can have a general duration of 2 hours, or any other duration through a personalized booking system.
The room price is fixed and cannot be reduced, even if there are fewer participants. If there are more participants, a surcharge must be paid.
6.2. PLAYBACK reserves the right to modify its prices at any time, guaranteeing the Customer the application of the current price on the day of booking.
ARTICLE 7 - BOOKING METHODS
7.1. The Customer will have the possibility to book the rooms on the website.
7.2. During the booking process, the availability of the rooms is indicated to the Customer in real time during the validation of their payment.
7.3. To book, the Customer clicks on their chosen time slot and then on the “Book” tab.
7.4. Next, the Customer provides the following information: name, last name, email address, and phone number, before clicking on the “Confirm” tab.
7.5. Before clicking on the “Confirm” tab, the Customer has the opportunity to verify the details of their booking and the total price.
7.6. Order confirmation implies the Customer’s acceptance of the GSC and the formalization of the contract.
7.7. Once the booking is validated, the customer receives an email sent by PLAYBACK (email@example.com) with the subject “Playback Madrid – Reservation Confirmation.”
ARTICLE 8 - PERSONAL DATA
8.1. When the Client makes a reservation for the first time, they will provide the following information: first name, last name, email address, and phone number.
ARTICLE 9 - FILE/PROOF
9.1. The archiving of order confirmations is done on a reliable and durable medium in order to constitute a faithful and lasting copy in accordance with Article 98.7 of Royal Legislative Decree 1/2007, of November 16, General Law for the Defense of Consumers and Users.
9.2. Order confirmations can be presented as evidence of the contract.
ARTICLE 10 - PAYMENT
10.1. Reservations are paid by payment cards.
10.2. The accepted payment cards to date are: Visa, MasterCard.
10.3. The Client guarantees the possibility of using their credit card for payment of room reservations made on the website.
10.4. PLAYBACK has the right to transmit banking data in a fully confidential and secure manner through the RedSys secure payment platform, or through any other platform with the same level of security that may replace the first one announced.
ARTICLE 11 - ACCESS TO THE ROOMS
11.1. The Client may access the rooms at the beginning of the reserved session on the website.
11.2. In case of delay by the Client, the session cannot be postponed.
Minors aged 16 to 18 are allowed access until 11:00 p.m.
Minors under 16 are allowed access until 11:00 p.m. if accompanied by their parent/guardian. In the case of 3 minors under 16, the respective parents of each minor must accompany them.
ARTICLE 12 - RESERVATION CANCELLATION AND MODIFICATION TERMS
12.1. The cancellation or modification of the reservation is made by the client through the email firstname.lastname@example.org.
12.2. The reservation can only be modified once (change of date, session, or room).
12.3. The client cannot modify their reservation with less than 72 hours’ notice before the start of their karaoke session.
12.4. The client can cancel their session at any time. The terms and conditions for refund or issuing a credit note are specified in Article 12.5.
12.5. For cancellation:
The Client will receive a full refund if they request cancellation at least 3 weeks before the start of the karaoke session.
The Client will be entitled to a credit note if they request cancellation between 3 weeks and 72 hours before the start of the karaoke session.
The Client will not be entitled to any refund or credit note if they request cancellation less than 72 hours before the start of the karaoke session.
If the client has made their reservation with less than 72 hours’ notice, we invite them to contact our customer service at email@example.com for any cancellation or room modification requests. The cancellation will be accepted, and a credit note will be issued.
12.6. The credit note is valid for 12 months only for the reservation of a new session.
12.7. This credit note cannot be reassigned in case of a new reservation cancellation. Only the monetary supplement used for a new reservation will be refunded or credited, always in accordance with our cancellation conditions mentioned above in Article 12.5.
12.8. The client does not have the right of withdrawal, in accordance with Article 103.l) of Royal Legislative Decree 1/2007, of November 16, General Law for the Defense of Consumers and Users.
Artículo 13 – Propiedad intelectual
13.1. All texts, comments, illustrations, works, and images reproduced or represented on the website are strictly reserved under copyright and intellectual property law, for the entire duration of the protection of these rights and for the whole world.
13.2. Any reproduction, representation, modification, or adaptation, in whole or in part, of the website www.playbackmadrid.com and/or all or part of the incorporated elements exposes the infringers to legal proceedings.
ARTICLE 14 - PROTECTION OF PERSONAL DATA
14.1. PLAYBACK is committed to respecting the confidentiality of personal data communicated by the client on the website as part of the room reservation, and to treat them in compliance with Regulation (EU) 2016/679 of April 27, 2016, General Data Protection Regulation, and Organic Law 3/2018 of December 5, 2018, on the Protection of Personal Data and Guarantee of Digital Rights.
14.2. PLAYBACK informs that the personal data communicated by the client will be used by its internal services for the processing of room reservations.
The data controller responsible for the processing is the company PLAYBACK MADRID, S.L., with VAT ID B67662676, registered office at Calle Piamonte, 12 – 28004 Madrid. The contact email for exercising rights related to data protection is: firstname.lastname@example.org
The legal basis for the processing of your data is the consent requested.
The purpose of the processing is to manage the reservation of karaoke rooms.
The provided data will be retained until you exercise your right to cancellation.
You have the rights of access to the data, rectification, erasure, as well as the right to object to the processing of your data.
To exercise your rights, you can submit a written request to the previously provided email address.
The data will not be transferred to third parties, except when required by law.
Finally, we inform you that the competent authority to address conflicts arising from the processing is the Spanish Data Protection Agency.
ARTICLE 15 - RETURN OF THE ROOM AND EQUIPMENT
The room and equipment made available to the client must be returned in a proper state of use. In the event of damage caused by the client to the rooms, equipment, or even common areas, repairs will be assessed, notified by email within thirty (30) calendar days, and must be paid by the client within fifteen (15) calendar days from such notification.
ARTICLE 16 - APPLICABLE LAW - DISPUTES
16.1. These General Conditions of Sale are subject to Spanish law.
16.2. For any claims, the client must contact the customer service of PLAYBACK at the following address: email@example.com, to seek an amicable solution. Otherwise, the Spanish Courts shall have jurisdiction.
